These Terms of Service (“Terms”) govern your use of thefidgetcompany.com (the “Site”) and any purchase you make from us. The Site is operated by Alboro Brands LLC, doing business as The Fidget Company (“The Fidget Company,” “we,” “us,” or “our”), 228 E Route 59 #218, Nanuet, NY 10954, United States. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. Our products are designed for adults. See Section 7 for age recommendations.
2. Products and descriptions
We try to describe and photograph our products accurately. Colors, finishes and sizes may vary slightly from what you see on screen, and materials are as stated on each product page. If a product you receive is not as described, your remedy is to return it under our Refund Policy.
3. Pricing and availability
All prices are in U.S. dollars and may change without notice. Applicable sales tax is calculated at checkout. If an item is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund any amount charged, even after we have sent an order confirmation. Products are subject to availability, and we may limit quantities.
4. Orders and payment
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, for example if we suspect fraud or cannot verify payment, and we will refund any amount charged for a cancelled order. Payments are processed securely by our payment providers. We do not store your full card details.
5. Shipping
Shipping methods, costs and estimated delivery times are described in our Shipping Policy. Delivery estimates are not guarantees. Title and risk of loss pass to you when the carrier delivers the package.
6. Returns and refunds
You may return eligible items within 30 days of purchase as described in our Refund Policy, which forms part of these Terms.
7. Product use and safety
Our fidget sets are adult desk accessories, not toys for young children. The Classic set is recommended for ages 14 and up and the Executive set for ages 17 and up. Some sets contain small parts and small magnetic spheres. Keep them away from young children and pets. If magnets are swallowed, seek medical attention immediately. Use the products only as intended and supervise any use by minors.
8. No medical claims
Our products are not medical devices and are not intended to diagnose, treat, cure or prevent any disease or condition. Any information on the Site about focus, stress or relaxation is general in nature and is not medical advice. See our Disclaimer.
9. Promotions and discount codes
Discount codes and promotions are subject to their stated terms, may be limited to one per order, have no cash value, and may be changed or withdrawn at any time.
10. Reviews and content you submit
If you submit a review, comment, photo or other content, you confirm that it is your own and truthful, and you grant us a non-exclusive, royalty-free license to display and use it in connection with our business. We may remove content at our discretion.
11. Intellectual property
All content on the Site, including text, images, video, product designs, logos and the “The Fidget Company” name, belongs to Alboro Brands LLC or its licensors and is protected by law. You may not copy, reproduce or distribute it without our written permission. Third-party names and trademarks mentioned on the Site belong to their respective owners.
12. Third-party links and services
The Site may link to third-party websites, such as Amazon or social media. We are not responsible for their content, policies or practices.
13. Disclaimer of warranties
Except as expressly stated in these Terms or required by law, the Site and products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, Alboro Brands LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Alboro Brands LLC from claims arising from your misuse of the Site or products or your breach of these Terms.
16. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Rockland County, New York, and you consent to their jurisdiction.
17. Changes
We may update these Terms from time to time. The “Last updated” date shows when they last changed. Continued use of the Site after changes means you accept the updated Terms.
